Terms & Conditions

Section 1: Introduction

The Road To Off Grid Competition Terms and Conditions are comprised of three sections:

  • Section 1: Introduction – this introduction.
  • Section 2: Competition Conduct Conditions – the conditions that govern the relationship between us and anyone who participates in any competition.
  • Section 3: Glossary and Definitions – the glossary and definitions that give special meanings to certain words used in these Terms and Conditions.

These Terms and Conditions are governed by the laws of England and Wales, and all parties are deemed to submit to the exclusive jurisdiction of the courts of England and Wales.

Important notices

Kitcatt Studios LLP trading as Road To Off Grid (“Road To Off Grid”, “we”, “us”, “our”) reserves the right to alter these Terms and Conditions at any time. Where alterations constitute a material change, we will notify users by email using the address associated with their account, or by placing a prominent notice on the website. What constitutes a material change will be determined by us at our sole discretion, acting in good faith and using common sense.

A prudent participant in a competition will:

  • read these Terms and Conditions;
  • check the content of all available documents relating to the competition and the prize;
  • take professional advice where appropriate.

These Terms and Conditions assume that each Entrant and Winner has acted like a prudent individual. If you choose to participate in a competition without taking reasonable precautions, you do so at your own risk.

If you enter a competition or otherwise participate in a competition, it is on the basis that you accept these Terms and Conditions. They govern Road To Off Grid’s relationship with you as an Entrant and, where applicable, as a Winner.

Road To Off Grid does not offer any competitions in any jurisdiction where such an offer or solicitation is unlawful or would impose any unfulfilled registration, qualification, publication or approval requirements. It is your responsibility to ensure that you are not located in a jurisdiction where it is unlawful for you to enter or participate in such competitions.


Section 2: Competition Conduct Conditions

The Promoter

The promoter of all competitions is Kitcatt Studios LLP trading as “Road To Off Grid” (a partnership registered in England and Wales with company registration number OC445541) (the “Promoter”). The registered office is Unit 5 Prospect Business Centre, Prospect Road, Alresford, Hampshire SO24 9UH.

Road To Off Grid operates prize competitions that are free from regulation under the Gambling Act 2005 in the United Kingdom.

Although the term “raffle” may be used on our website and in marketing materials, this is for descriptive and search engine optimisation purposes only. As every competition offers a free entry route by post, the competitions are legally classified as prize competitions or free draws rather than regulated raffles or lotteries.

Further information about the laws and regulations on raffles and prize competitions is available from the Gambling Commission website, www.gamblingcommission.gov.uk.

Eligibility

To enter a competition:

  • you must be aged 18 years or over at the time of entry; and
  • you must not be physically located in a jurisdiction where it is unlawful for you to enter a competition of this type.

Each competition page will specify the country or countries from which entries are permitted. If you are resident in, or entering from, a country that is not listed as eligible for that competition, your entry may be void.

By entering a competition, you confirm that you are eligible to do so and eligible to claim the prize you may win. We may require you to provide proof that you are eligible to enter the competition (for example, age and address verification). If you cannot provide satisfactory proof, your entries may be void and any prize withheld.

We will not accept competition entries that are:

  • automatically generated by computer or script;
  • completed by third parties or in bulk;
  • altered, reconstructed, forged or tampered with.

Joint submissions are not allowed. Each entry must be made in the name of a single eligible individual. Tickets may be purchased as gifts, but the person named on the entry will be treated as the Entrant and must meet all eligibility requirements.

We reserve all rights to disqualify any Entrant or Winner if their conduct is contrary to the spirit or intention of the prize competition.

User accounts

To enter a competition (including by postal entry), you must hold a user account on the Road To Off Grid competition website. You must ensure that the information in your account is true, accurate and kept up to date, including your name, email address and contact details.

You are responsible for keeping your account login details secure and for all activities that take place under your account. If you become aware of, or suspect, any unauthorised use of your account, you must notify us as soon as reasonably practicable.


How to enter a competition

Each competition will run from its opening date to its closing date (both inclusive), as stated on the competition page.

In order to enter a competition, each Entrant must either:

  • select the paid online entry option; or
  • submit a free Postal Entry in accordance with these Terms and Conditions.

By purchasing a ticket and/or entering a competition, including by way of a Postal Entry, each Entrant (including any Winner) agrees to be bound by these Terms and Conditions and any additional conditions stated on the competition page.

To enter using the paid online entry option, you must:

  • log into your account or create an account during checkout;
  • select the number of tickets you wish to purchase (subject to any entry limits shown on the competition page);
  • answer the competition question by selecting one of the multiple‑choice options;
  • pay for the tickets using an accepted payment method.

Ticket payments are strictly non‑refundable.

We may accept your payment and issue tickets regardless of whether your answer is correct. However, only tickets associated with the correct answer to the competition question will be entered into the final draw.

Free Postal Entry

Every competition offers a free entry route by post (“Postal Entry”). Postal Entries are not for sale and can be made free of charge.

To enter a competition through a Postal Entry:

  • you must hold a valid user account on the Road To Off Grid competition website and have verified your email address;
  • each Postal Entry must be sent on a plain postcard or unenclosed card (no enclosed envelopes) to the postal address stated on the website;
  • each Postal Entry must include, clearly handwritten:
    • your full name;
    • the email address associated with your user account;
    • your postal address;
    • your contact telephone number;
    • the unique code of the competition you wish to enter;
    • your answer to the competition question.

Each postcard may contain details for one competition only and represents one entry for that competition.

Postal Entries must be received before the competition closing date and time. Entries received after the closing date will not be included in the draw.

We reserve the right to reject Postal Entries that do not meet these conditions, that are illegible or incomplete, or that are otherwise non‑compliant with these Terms.

We accept no liability for any postal delays, lost or damaged entries, or any event beyond our reasonable control that affects the receipt of Postal Entries. Proof of posting is not proof of receipt.

Valid Postal Entries with the correct answer will be treated in exactly the same way as paid entries with the correct answer and will be entered into the final draw on an equal footing.

Competition question

Each competition will include a simple multiple‑choice question, which may relate to the Road To Off Grid channel or its projects. Only entries which correctly answer the competition question will be included in the final draw. If you choose the wrong answer, your tickets will not be entered into the draw.


Geographic entry and shipping

Each competition page will specify the country or countries from which entries are accepted and to which the prize can be shipped. Only residents of, and addresses within, those countries may receive the prize.

We will cover reasonable standard shipping costs to the countries specified on the competition page and in the shipping options during checkout. Shipping outside those countries is not included.

If a winner is found to reside outside the shipping area (for example, by using a third‑party address or by misrepresenting their location), we may:

  • void the prize and redraw a new winner; or
  • allow the winner to arrange their own collection or forwarding of the prize at their own cost and risk, subject to our agreement.

Taxes, duties and import charges

Unless expressly stated otherwise on the competition page, the Winner is solely responsible for any taxes, duties, customs charges, import VAT, brokerage fees or other similar charges levied by their local authorities or any carrier in connection with delivery of the Prize outside the United Kingdom.

Where required for customs or tax purposes, we will declare a reasonable value for the Prize on the relevant documentation. The fact that the Winner receives the Prize free of charge does not mean that local taxes or import charges will not apply.

We will not reimburse the Winner for any such taxes, duties or charges, and we will not be liable if the Winner fails to pay them and the Prize is delayed, returned or destroyed by the carrier or local authorities. If the Winner does not pay such taxes, duties or charges when due and, as a result, the Prize cannot be delivered and is returned to us or destroyed, we are not obliged to provide a replacement prize, a cash alternative, or any other form of compensation.

The prize

The prize for each competition is as described in the competition particulars on the website.

The prize is not negotiable or transferable and there is no cash alternative unless expressly stated on the competition page.

Unless stated otherwise, the winner is responsible for any ongoing costs associated with the prize, such as insurance, tax, registration, fuel, maintenance or installation.


Winners and the draw

On or after the closing date, all entries with the correct answer (including valid paid and Postal Entries) will be entered into a random draw. A winner (and, where applicable, runners‑up) will be selected at random from all such entries.

The decision of Road To Off Grid in relation to the conduct of any competition and the selection of the winner is final and no correspondence or discussion will be entered into, save in the case of obvious error.

We will publish or make available information that indicates that a valid award took place, which may include the winner’s first name and county/country. We will process any personal data in accordance with our Privacy Policy.


Notifying and claiming the prize

We will attempt to contact the winner as soon as reasonably practicable after the draw using the email address and/or telephone number provided with their account or entry.

The winner will have 21 days from our first attempt to contact them to respond and claim the prize. If the winner does not respond or cannot be contacted within this time, or fails to meet the eligibility requirements, we reserve the right to withdraw the prize and either:

  • select a new winner by random draw; or
  • close the competition without awarding the prize, as stated on the competition page.

The prize may not be claimed by a third party on the winner’s behalf unless we agree otherwise in writing.


Delivery and collection

Details of whether delivery is included and to which locations will be specified on each competition page.

Where delivery is included, we will use reasonable efforts to arrange delivery to the Winner at a mutually convenient time and place, within the permitted shipping area. Any local taxes, duties or import charges remain the responsibility of the Winner, as set out in these Terms.

Where collection is required, the winner and Road To Off Grid will agree a reasonable time and location for collection. The winner is responsible for attending the collection and bringing any identification or documents requested.

Once the prize has been dispatched for delivery or collected by the winner, risk in the prize passes to the winner. We are not responsible for any loss, damage or theft after that point.

Because there is only one physical prize for each competition, we are not able to send a replacement prize if it is lost, stolen or irreparably damaged in transit. If you have not received the prize, or it arrives significantly damaged, you must notify us as soon as reasonably practicable and in any event within 21 days of the date we confirm dispatch or collection. We will investigate the issue with you and the carrier and, if we are satisfied that the prize has not been received and cannot reasonably be delivered, we may, at our discretion, provide a remedy such as a cash alternative funded from up to 75% of the total ticket sales for that competition.

Cancellations and changes

We reserve the right to hold void, suspend, cancel or amend any competition where it becomes necessary to do so, for example due to technical failure, fraud, legal or regulatory reasons, or events beyond our reasonable control.

Paid entries are non‑refundable, except where a competition is cancelled before a winner is drawn or where we are required by law to offer a refund. In the event of cancellation, we may refund entry fees or provide equivalent entry credit, as described on the website.


Limitation of liability

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

To the extent permitted by law, Road To Off Grid and its partners will not be responsible or liable to compensate any Entrant or Winner or accept any liability for any loss, damage, personal injury or death arising out of or in connection with entering a competition, taking up a prize, or the use of the website, except where caused by our negligence or other breach of legal duty. Your statutory rights are not affected.


Section 3: Glossary and Definitions

In these Terms and Conditions:

  • Competition means a prize competition or free draw operated by Road To Off Grid and described on the website.
  • Entrant means a person who validly enters a Competition in accordance with these Terms.
  • Prize means the item or experience described for a Competition.
  • Promoter means Kitcatt Studios LLP trading as Road To Off Grid.
  • Postal Entry means a free entry made by post in accordance with these Terms.
  • Winner means the Entrant whose valid entry is selected at random in the draw.

Where the context permits, words in the singular include the plural and vice versa, and references to any legislation include that legislation as amended or re‑enacted.
